Selecting a Dog Bite Lawyer

Many people - those who are fortunate - go through life never needing the services of a civil trial lawyer. However, when a dog attack affects you and your family, you might need legal assistance. How do you choose a lawyer? We suggest that you look at several things.

First, is the lawyer competent? All Texas lawyers must pass the Texas Bar examination, evidencing a minimum level of competence. However, lawyers choose to practice in different legal areas. A lawyer who chooses to concentrate his practice on family law might not know the law applicable to personal injury cases. Likewise, a lawyer who chooses an estate planning practice might not be familiar with dog bite law and/or the rules of evidence and procedure necessary to prosecute and try a lawsuit.

Second, does the lawyer have integrity? This is a quality that is difficult to measure. Talk to the lawyer who you are considering retaining. Do you feel comfortable? Does it seem to you that the attorney cares about you and your case? Does the lawyer give you a feeling of comfort?

Third, what is the lawyer's reputation? Search the Internet. Does the attorney appear to actively pursue his client's cases? Does the lawyer's Internet presence appear to indicate that he acts appropriately and in the best interest of his clients? Has the lawyer handled cases with significant amounts at stake?

Fourth, is the lawyer willing to take your case to trial if necessary? Usually, if a civil trial lawyer handling a dog bite case is acting in his client's best interest, he will attempt to resolve the case without going to trial. However, there are a number of reasons that a case might not settle. A defendant or a defendant's lawyer or insurance company might not act reasonably, or might not evaluate a case properly. A defendant might want to fight a case through trial even if the defendant's liability is clear. A defendant or her insurance company might not offer enough compensation for damages suffered as a result of the animal attack. There are many possible reasons that a case might not settle before trial. When a defendant or her lawyer or insurance company refuses to settle, will the lawyer you are considering take your case to trial? When was the last time that the lawyer you are considering tried a case? Is the prospective attorney comfortable trying your case to a jury? You should only retain a lawyer who is willing to go the distance if necessary. Otherwise, you might not obtain sufficient compensation.
